Proprietary odds from Swish were allegedly found on several competitor’s sites.

Swish Analytics has filed a lawsuit with the Superior Court of California against OddsJam and OpticOdds.
The complaints include misappropriation, “Hot News” misappropriation, restitution, unjust enrichment and unfair competition.
According to Swish, a “substantial portion” of the defendants’ business involves “misappropriating Swish’s proprietary odds information [appearing] on various sportsbooks and other users of sports odds data, and then republishing and selling access to that information” and “attempted to directly compete with Swish by offering sportsbooks and other customers access to Swish’s own proprietary information taken from Swish’s sportsbook partner websites in an effort to undercut Swish.”
Swish claims that damages from this accumulate to “at least” $100m and is “likely significantly more.”
Operators including FanDuel and bet365 are licensed partners of Swish and the company covers sports such as the NFL, NBA, NHL and others.
Earlier this year, Altenar expanded its partnership with Swish Analytics for its Major League Baseball betting offerings with new micro-betting options and fast markets.
Evidence submitted includes screenshots where OpticOdds is using the same odds as Swish’s proprietary products across several sporting leagues.
Swish claims that the companies in question “ knowingly accessed the computers, computer systems, or computer networks of Swish’s licensees in order to take, copy and make use of Swish’s proprietary odds information without permission” and sell those odds on their own sites.
Good to know: Both Swish and the defendants conduct business in California, which is one of the key pillars of the unfair competition argument
While the defendants are yet to release a statement on the lawsuit, Ryan Weinstock CCO of OpticOdds had posted on LinkedIn recently that one of the company’s main goals was to “scale our marketing efforts and expand our team to help emerging sportsbooks compete with industry leaders.”
